STATEMENT FOR PRIVACY WHEN PERFORMING VIDEO SURVEILLANCE

This Privacy Statement explains the type of personal data that Makoten Dooel Gevgelija (hereinafter: the Controller) collects from you when visiting the office / business premises and the manner in which the Controller uses this data.

 

  1. Why do we collect (process) personal data?

The controller collects personal data through the video surveillance system for the following reasons (purposes):

– to control the access to the facility (building, entrance, premises …) and to ensure the security of the facility, the safety of the Controller staff and visitors, as well as the property and information that are located or stored in the premises;

– to prevent, deter and, if necessary, investigate unauthorized physical access, including unauthorized access to security and protected premises, IT infrastructure or operational information; and

– to prevent, detect and investigate the theft of equipment or assets owned by the Controller, visitors or staff, or to threaten the safety of staff working on the premises (for example: fire, physical assault).

The video surveillance system is not used for any other purpose, such as monitoring the work of employees or their presence. The video cameras are positioned so that they do not cover the surrounding public space. The cameras / devices aim to give an overview of what is happening in certain places, with the possibility of recognizing people.

The video surveillance system is also not used as an investigative tool or to obtain evidence in internal investigations or disciplinary proceedings, unless it is a security incident that has established video surveillance under the Personal Data Protection Act. (In exceptional circumstances determined by law, the data may be transferred to the investigating authorities within the framework of a formal disciplinary or criminal investigation).

Video surveillance cameras are installed on / in the premises of the Controller and are positioned and focused so that only persons who will enter or access the office / business premises (facilities), including the property (for example parking) are filmed.

The video surveillance system covers the area of: the entrances and exits of the facilities, the entrances to the garage and the inner part of the same and the outer surface of the facilities (parking) as well as the corridors inside the facilities, ie the rooms where games of chance and others take place and activities arising from the activity of the controller.

 

  1. What data does the Controller collect?

The controller collects only images captured on the cameras, and in the premises of the casinos where the games of chance take place and at the entrances, audio recording is performed.

 

  1. Who is responsible for data processing?

The controller is the only entity that performs the processing of personal data and which determines the purposes of processing, only in accordance with the Law on Personal Data Protection.   1. What is the legal basis for processing personal data through the video surveillance system?

The controller uses video surveillance equipment for:

– protection of human life or health;

– protection of property;

– protection of the life and health of the employees due to the nature of the work; or

– providing control over the entry and exit from the official or business premises.

Therefore, the processing is legal and is in accordance with Article 90 of the Law on Personal Data Protection (Official Gazette of the Republic of Northern Macedonia no. 42/20120).

In addition, at the entrance and in the premises of the Controller there is a visible and clearly displayed notification for the video surveillance which enables the personal data subjects to be informed with detailed information related to the performance of the video surveillance, especially for the name of the controller performing the video surveillance and how information can be obtained about where and how long the video from surveillance system is stored.

 

  1. Who can see my personal information?

The videos can only be accessed by the Video Surveillance Authority (for example: members of the Controller’s security staff). Access to the digital device or disk on which the videos are stored is restricted, protected by the application of technical data security measures (password, record of each event or action by employees, ie authorized persons). The data, ie the videos cannot be accessed without authorization by the management of Makoten Dooel Gevgelija as a Controller.

  1. Can I access my data?

You have the right to access your data at any time and free of charge, by sending a request to Hotel Flamingo Bogorodica, Bogorodica Border Crossing, 1480 Gevgelija, or by e-mail to: dpo@casino-f.com.

 

  1. Can I change my data?

It is not allowed to modify the recording for video surveillance or audio surveillance (audio recording).

 

  1. Can I request a restriction on the processing of my data?

You have the right to restrict the processing of your personal data at any time by sending an e-mail request to: dpo@casino-f.com or to the address: Hotel Flamingo Bogorodica, Border Crossing Bogorodica, 1480 Gevgelija), and especially when you dispute the accuracy of your personal data, or when you feel that the Controller no longer needs the data to pursue his legitimate interest. You can also block the processing of your personal data when you feel that the operation is illegal and when you object to the deletion of the data. However, keep in mind that blocking, ie restriction is not possible in every case and especially not in the case of an official investigation within the Controller or upon request or for the purposes of an appropriate procedure in accordance with the law of a competent authority or institution.

 

  1. Can I delete my data?

You have the right to request deletion of your personal data at any time, by sending a request to: dpo@casino-f.com, ie to the address of Hotel Flamingo Bogorodica, Border Crossing Bogorodica, 1480 Gevgelija, when you consider that the processing of your personal data is illegal.

 

  1. Is my personal information shared with other people?

Your data is stored with the Controller, unless you request it from the Controller or consent to its sharing. In the event of your data being shared with third parties, you will be notified to whom it was disclosed, for what purpose and on what legal basis.

 

  1. Do I have the right to object?

Yes, you have the right to object and to oppose the processing at any time by sending a request to dpo@casino-f.com, ie to the address of Hotel Flamingo Bogorodica, Bogorodica Border Crossing, 1480 Gevgelija. When you consider that you have legitimate reasons regarding your particular situation and submit a request, the Controller will act on your request within 15 days from the date of submission of the request.

 

  1. What can I do in case of a problem?

a) The first step is to notify the Controller by sending an e-mail to info@casino-f.com and asking him to take action.

b) The second step, if you do not receive a response from us or if you are not satisfied with it, contact our personal data protection officer at dpo@casino-f.com.

c) At any time you can contact, ie submit a request to the Agency for Personal Data Protection www.azlp.mk, which will act upon your request and will adopt the necessary measures in the capacity of a competent regulatory body.

 

  1. When will the processing of my personal data through the video surveillance system start?

The processing starts at the moment when you visit the premises or facilities of the Controller.

 

  1. Security of personal data

The controller is fully committed to the protection of your personal data. Therefore, the Controller use security technologies and procedures that protect your personal information primarily from unauthorized access, use or disclosure. We store your data on restricted access computer systems and in a controlled environment.

 

  1. How long do we store your data?

The controller will store your personal data for a maximum of 30 (thirty) days after your visit to our premises, ie until the capacity and technical capability for storing the data on the devices are met, after which all recorded videos are automatically deleted.
